Terms of Service

1. Acceptance of Terms

By accessing or using QSL Exchange ("the Service", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all visitors, registered users, and paying members of QSL Exchange, regardless of location.

2. Description of Service

QSL Exchange is an online platform for licensed amateur radio operators that provides:

• A digital logbook for recording QSOs (amateur radio contacts)
• A NetQSL system for exchanging digital QSL confirmation cards
• A community-maintained repeater database
• Contest calendars, statistics, and callsign lookup tools
• An API for third-party integrations (paid tiers)

Features vary by membership tier (Free, Basic, Pro) as described on the pricing page.

3. Eligibility

You must be at least 16 years of age to create an account. The Service is primarily designed for licensed amateur radio operators. You are responsible for ensuring your use of the Service complies with any applicable amateur radio regulations in your jurisdiction.

By registering, you confirm that the callsign(s) you provide are either:

• Assigned to you by a national licensing authority, or
• Assigned to a club, organisation, or station for which you are an authorised operator.

We reserve the right to suspend accounts where callsign authenticity cannot be verified or where misuse is suspected.

4. Account Registration and Security

You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.

Notify us immediately at support@qslexchange.com if you suspect unauthorised access to your account. We are not liable for losses resulting from unauthorised access where you have not taken reasonable precautions.

Each account must correspond to a single individual or entity. Sharing accounts is not permitted.

5. Acceptable Use

You agree not to use the Service to:

• Submit false, fabricated, or misleading QSO records or callsign information
• Harass, impersonate, or harm other users
• Upload, transmit, or store unlawful, offensive, or infringing content
• Attempt to gain unauthorised access to other accounts or our systems
• Scrape, crawl, or bulk-download data without prior written permission
• Use the Service for commercial advertising without authorisation
• Interfere with the availability or performance of the Service
• Circumvent any usage limits or access controls

Violation of these rules may result in immediate suspension or termination of your account without refund.

6. User-Generated Content

You retain ownership of the content you upload (logbook entries, QSL card messages, repeater data, profile information). By submitting content to the Service, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and process that content solely to provide and improve the Service.

You represent that you have the right to submit any content you provide, and that it does not infringe the rights of any third party.

Repeater database entries are contributed by the community and are made available publicly. By submitting repeater information, you agree that it may be displayed to all users.

7. NetQSL and Email Delivery

The NetQSL system sends QSL confirmation emails on your behalf to other amateur radio operators. By using this feature, you acknowledge that:

• Recipient callsigns may be non-users of the platform who receive emails via their public contact information
• Recipients can opt out of receiving NetQSL emails at any time via the opt-out page
• You must not use the NetQSL system to send unsolicited or abusive messages

8. Membership and Billing

Paid memberships (Basic and Pro) are billed annually in Euros (EUR) via Stripe. All prices are displayed inclusive of any applicable taxes where required by law.

Renewals: Subscriptions renew automatically at the end of each billing period unless cancelled.

Cancellation: You may cancel at any time from your membership settings. Access continues until the end of the current paid period; no partial refunds are issued for unused time, except where required by applicable law.

Refunds: We offer a 14-day refund for first-time subscriptions if you are dissatisfied and have not exceeded reasonable use of paid features. Contact support@qslexchange.com within 14 days of initial payment.

Price changes: We will provide at least 30 days' notice before any price increase takes effect. Your subscription price is locked until renewal.

Payment processing is handled by Stripe, Inc. QSL Exchange does not store full payment card details. Stripe's terms apply to payment transactions.

9. Free Tier

The Free tier is provided without charge and without any guarantee of continued availability. We reserve the right to modify, restrict, or discontinue free features at any time with reasonable notice.

10. Intellectual Property

The QSL Exchange name, logo, design, software, and documentation are owned by QSL Exchange and protected by applicable intellectual property law. You may not copy, reproduce, or create derivative works from our materials without prior written permission.

The Service may contain open-source components governed by their respective licences.

11. Service Availability

We strive for high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance will be communicated in advance where reasonably possible. We are not liable for losses arising from temporary unavailability.

12. Account Deletion

You may request deletion of your account from your profile settings. Deletion requests enter a 30-day grace period during which you may cancel the request. After 30 days, your personal data is permanently deleted in accordance with our Privacy Policy.

We may retain certain data beyond deletion where required by law (e.g. invoicing records).

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy of logbook data, or uninterrupted service.

QSL records on this platform are user-submitted and have not been independently verified. QSL Exchange does not guarantee their accuracy for award applications or official purposes.

14. Limitation of Liability

To the maximum extent permitted by applicable law, QSL Exchange and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising out of or in connection with your use of the Service.

Our total aggregate liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the European Union and the jurisdiction in which QSL Exchange is registered. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or by a notice in the Service at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
